Com o escopo de realizar uma análise minuciosa dos seus reflexos jurídicos, confrontando a opinião de grandes autores sobre o assunto, este trabalho demonstra que o Supremo Tribunal Federal já editava decisões com efeito vinculante, Como também, pretende-se com este, decantar analiticamente o contexto social e político que receberá esse novo instituto, com a promessa de dar celeridade à prestação jurisdicional, proporcionando ao jurisdicionado maior segurança, eficiência, igualdade e legalidade.The present monograph concerns with the introduction of the Stare Decisis of exclusive use of the Supreme Court of Brazil in the brazilian legal system, after the enactment of the Constitutional Amendment n. 45, on December 31st, 2004. With the purpose of making a detailed analysis of its legal reflections, by confronting great authors on the subject, this work demonstrates that the Supreme Court of Brazil has already published decisions with binding effect.
