Atualmente existe grande discussão acerca da submissão das empresas estatais à Lei nº 8.666/93, tanto as prestadoras de serviços públicos como as exploradoras de atividade econômica. Discute-se ainda qual o procedimento será adotado pelas empresas estatais quando da edição da lei regulamentadora do estatuto jurídico das empresas públicas e das sociedades de economia mista que explorem atividade econômica. Para alguns autores, as empresas estatais estariam submetidas ao regime geral de licitação previsto na Lei nº 8.666/93, enquanto para outros o art. 173 da Constituição Federal definiu que essas empresas estariam sujeitas a um regime diferenciado. A questão central diz respeito à ausência da lei que institua o regime jurídico das empresas estatais, definindo o procedimento licitatório a elas aplicável, ponto que será analisado no presente estudo, com a análise dos principais posicionamentos doutrinários e jurisprudenciais a respeito do tema.The present monograph approaches the obligatoriness of bidding procedure realization by state-owned company (joint capital company and public company), mainly those that have as object the exploration of economic activity, by the reason of the non-edition of the predicted law in article 173, § 1º of Federal Constitution which should dispose about the bidding regime applicable to those entities. Nowadays there is a large discussion about the state-owned company submission to the Law nº 8.666/93, both the public service providers as the economic activity explorative. Still discusses which procedure will be adopted by state-owned company when the law regulatory of joint capital company and public company explorative of economic activity juridical statute be edited. For some authors, the state-owned company would be submitted to the general regime of bidding predicted in the Law nº 8.666/93, whereas for others authors the article 173 of Federal Constitution defined that these companies would be submitted to a different regime.
