De um lado se observa a tentadora possibilidade de solução de um problema que limita a dignidade das pessoas na causa homoafetiva – possibilidade de fato e de direito de homossexuais constituírem família – o problema estatal do abrigamento de menores – abandonados ou retirados de suas famílias for medida protetiva e que necessitam de um lar definitivo – e do outro os direitos da criança e do adolescente, que tem constitucionalmente assegurada sua condição de sujeito de direitos, prioridade no respeito a seus interesses em detrimento de outros grupos e respeito a sua peculiar condição de ser humano em desenvolvimento, com todas as fragilidades advindas dessa condição. Equilibrar a transversalidade dos direitos envolvidos não é uma tarefa fácil, mas cabe aos grupos envolvidos e ao Estado, na amplitude de sua organização e esferas de atuação, olhar para a questão homoafetiva e para os direitos da criança e do adolescente com o comprometimento necessário ao trato dessas questões, que, embora representativas de minorias sociais, exigem respeito e urgência em sua promoção ou estabelecimento. Pretende-se demonstrar implicações e efeitos da adoção por casais homoafetivos nesse momento, marcadamente constituído por uma sociedade extremamente homofóbica e apresentar a importância de se preservar as crianças e adolescentes pelas garantias constitucionais já positivadas e pela mensuração de pertinência, que faz juízo dos princípios conflitantes para definir qual é o mais necessário para se atingir a justiça em dado momento.Althought it is not set up yet as a legal family institution, and therefore legitimate, in fact the homosexual arrangements are configured as real hoseholds. On one side you look at the tempting possibility of solving a problem that limits the dignity of the people in the homossexual case - possibility of fact and right of homosexuals costituting a family -, and the state problem of minors sheltering - abandoned or removed from their families for protective measure and need a permanent home-, on the other side the rights of children and teenagers, which is constitutionally guaranteed their status a subject of rights, priority in respect of their interests to the detriment of the other groups and respect their peculiar condition of a developing human, with all the weaknesses arising from this condition. Balancing the mainstreaming of the rights involved is not an easy task, but it is up to the groups involved and the State, the amplitude of their organization and spheres of acting, look to the homoafetiva issue and the rights of children and teenagers with the necessary commitment to the treatment of these issues, that, although representing social minorities, demand, respect and urgency on their promotion or establishment.
