Apesar de as novas tendências acerca da vítima se estenderem a outros setores jurídicos, o presente trabalho se vincula especificamente à vítima de crime. Com o objetivo de esclarecer quais são os direitos e garantias que lhe são assegurados, aborda o papel que a vítima do crime exerceu e exerce no decorrer da história, o modo como o tema é abordado junto às disciplinas de Criminologia, Vitimologia e Direitos Humanos; procura esclarecer os interesses da vítima e as regras acerca de sua participação no âmbito da justiça penal convencional e da Lei 9.099/95. Aborda também sobre as primeiras experiências de Justiça Restaurativa no Brasil, e o direito de participação contraditória no processo penal de iniciativa pública segundo a interpretação constitucionalmente adequada; bem como a necessidade de amparo e proteção da vítima.This work consists in a protective system of the victim of crime in the Brazilian legal system. Although the new trends about the victim extending to other sectors, this work is bound specifically to victim of crime. In order to clarify what are the rights and guarantees provided to it, addresses the role the victim of the crime and he exercises over the course of history, how the issue is dealt with the subjects of Criminology, Victimology and Human Rights; seeks to clarify the interests of victim and rules about their participation in the criminal justice conventional and the Law 9.099/95.
