Monografia (Graduação) - Universidade Católica de Brasília, Brasília, 2007.https://repositorio.ucb.br:9443/jspui/handle/10869/3387DireitoO presente trabalho visa demonstrar a importância dos pais na vida da criança, bem como que o não cumprimento dos deveres inerentes ao poder familiar, em especial o dever de educação, criação e convívio, violam a dignidade humana, por conseguinte os direitos personalíssimos da criança, prejudicando seu saudável desenvolvimento, ensejando assim a destituição do poder familiar quanto a indenização civil por dano moral. O estudo foi realizado através da aplicação de uma abordagem dedutiva das instituições em apreço, com técnica de pesquisa indireta bibliográfica e interpretação sociológica da lei. Ao final alcançou-se o entendimento de que os danos que impedem a formação psicossocial da criança devem ser passíveis de indenização compensatória, além da aplicação da sanção de destituição do poder familiar, evitando a impunidade e reprimindo a futuras condutas que culminem com o abandono afetivo do menor.This work aims to demonstrate the importance of parents in the children lifes, and that failing the duties inherent to power family, in particular the duty to education, development and coexistence, violating human dignity, therefore the rights of this child, damaging their healthy development, becoming then the dismissal of the family as compensation for civil moral damages.The study was performed by applying a deductive approach of the institutions in question, with the search indirect technical literature and sociological interpretation of the law.
