Ambos os sistemas jurídicos nos dias atuais não devem ser aplicados de forma estática, e sim de maneira convergente, pois a convergência dos dois sistemas tende a fortalecer a efetividade, racionalização e segurança jurídica na prestação da jurisdição.The institute of the binding precedent, consecrated in the article 103-A of the Federal Constitution of 1988, represents the consecration of the racionalizador effect of the jurisdictional power, as well as the approach of the two great families of the right, the civil law and common law.
