A atual estrutura, além de promover o crescimento socioeconômico, expõe constantemente o meio ambiente a riscos indesejáveis. É inviável estancar o crescimento econômico como forma de preservar o meio ambiente, portanto a questão ambiental deve ser gerida juntamente com o problema do risco. A tolerabilidade dos riscos indesejáveis deve ser descrita pelas normas de direito material, contudo, por vezes, o direito material é insuficiente para a proteção do meio ambiente, assim o direito processual exerce aplicabilidade às garantias oferecidas pelas normas matérias, visto ser imprescindível que se disponha de técnicas compatíveis com as peculiaridades do direito ambiental. Neste trabalho faremos o estudo das modalidades de tutela mais adequadas a defesa do meio ambiente, além do estudo dos princípios norteadores da proteção ambiental, com o propósito de verificar se, por meio do direito processual, é possível assegurar ao cidadão o seu direito fundamental ao meio ambiente ecologicamente equilibrado e legálo as futuras gerações.The profound changes in social structure and created new economic demands that have increased the degree of complexity of the relations of production and consumption in society. The current structure, in addition to promoting socioeconomic growth, the environment constantly exposed to unwanted risks. It is impossible stanch economic growth as a way to preserve the environment, so the environmental issue should be managed along with the problem of risk. The tolerability of risk events should be described by the rules of substantive law, however, sometimes the right material is insufficient for the protection of the environment, so the procedural law applicable exercise the guarantees offered by the rules matters, because it is essential that available techniques compatible with the peculiarities of environmental law.
