A incidência das atenuantes quando a penabase é fixada ao mínimo legal dá margens para muitas discussões, uma vez que a doutrina predominante corre por um lado e a jurisprudência majoritária vai por outro. Um ponto importante que foi discutido, é a revogação do sistema antigo e Critério Trifásico da aplicação da pena que é o sistema que mais condiz com o Princípio da Individualização da Pena, uma vez que realmente aplica a sanção levando em consideração não só o delito, mas sim as circunstâncias pessoais do agente. Portanto, se realmente for obedecido o Princípio da Individualização da Pena e atendendo os objetivos da aplicação da pena, com base na lei teremos realmente uma sanção justa, de forma que as circunstâncias atenuantes serão considerados direito do réu, devendo incidir independente de qual for a pena-base fixada.This research has as objective to analyze the incidence of the extenuating circumstances when the penalty base will be fixed at least legal. The incidence of the extenuating circumstances when the penalty-base is fixed to the legal minimum of the edges for many quarrels, a time that the predominant doctrine runs on the other hand and the majority jurisprudence goes for another one. An important point that it was argued, is the revocation of the old system and Three-phase Criterion of the application of the penalty that is the system that with the beginning of the personal of the Penalty, a time that really applies the sanction leading in consideration not only the delict, but yes the personal circumstances of the agent.
