A Convenção sobre o Sequestro protege a criança dos danos causados pelo repentino deslocamento para Estado estrangeiro, garantindo ao genitor o direito de guarda ou visita violado pela subtração ilegal realizada pelo outro pai. No trabalho são abordados os mecanismos de funcionamento da Convenção, requisitos para os países interessados aderirem ao acordo, estrutura administrativa necessária para a colaboração processual com os demais Estados-membros e hipóteses excepcionais em que os efeitos da Convenção poderão ser afastados em pró do melhor interesse da criança. O trabalho monográfico examina a adesão e aplicação da Convenção de Haia de 1980 no Brasil, o empenho das autoridades administrativas e judiciárias quando requisitam ou são requisitadas por outros países para colaborarem com a Convenção. A Autoridade Central e Judiciária brasileira ainda enfrentam problemas devido à falta de conhecimento das autoridades judiciárias acerca do funcionamento da Convenção e ausência de um rito específico para o deslinde da causa no âmbito judiciário.This work studies the Hague Convention on the Civil Aspects of International Child Abduction, the Convention aims to return children illegally removed or retained in other countries without the consent of both parents. The Convention on the Sequestration protects the child from harm caused by the sudden shift to a foreign state, guaranteeing the parental rights of custody or visits violated by illegal subtraction performed by the other parent. At work we focus on the working mechanisms of the Convention requirements for the countries concerned to adhere to the agreement, the administrative structure necessary for procedural cooperation with other Member States in exceptional circumstances and that the effects of the Convention may be removed in the better interest of the pro the child. This monographic work examines the adherence to and implementation of the Hague Convention of 1980 in Brazil, the commitment of administrative or judicial order or when they are needed by other countries to cooperate with the Convention.
