Os novos fluxos migratórios e a política imigratória nacional

Resumo: A presente pesquisa tem por objetivo analisar os novos fluxos migratórios vivenciados hoje no Brasil diante da legislação vigente e a atual política imigratória nacional. Discute-se os motivos que levaram ao recente e numeroso fluxo imigratório, principalmente de pessoas vindas do Haiti e do continente africano, e o tratamento dado a elas diante da desatualização do Estatuto do Estrangeiro, lei anterior a Constituição e altamente discriminatória. Para compreensão da matéria faz-se necessário a definição de refúgio e a discussão quanto a existência ou não de “Refugiados Ambientais”. Constituiu, também, objeto de estudo a política brasileira de abertura de suas fronteiras e, em contrapartida, a necessidade de uma verdadeira acolhida, com o desenvolvimento de políticas públicas voltadas a essas pessoas. Por fim, diante do atual contexto imigratório mundial, estuda-se a necessidade de um compromisso para se evitar novos deslocamentos forçados.

We discuss the reasons that led to the recent and numerous migration, especially from people from the Haiti and the African continent, and the treatment that are given to them before the discontinuity of the Foreigner Statute, previous law of the Constitution and highly discriminatory. For better understanding this research it is necessary the definition of refugee and the argument as if the existence of “Environmental Refugees”. It is also object of study the Brazilian opened borders policy and, on the other hand, the need for shelter, with the development of public policies focused on those people.
