The research concentrates efforts in the analysis of the deterioration of the workers' rights, due to a global imposition of the insertion of the states in the globalized economy. Globalization has provided the free movement of goods, services, capital and people, leading the world to the era of the society of organizations, which has enabled entities to opt for a more favorable jurisdiction in terms of labor costs. As a consequence of this phenomenon, the planning of the labor legislation had to adapt to the transformations in the ambit of the world-economy, which generated impacts in the well-organized society. The precariousness of labor relations is already a reality in several countries of the globe, including in Europe, the cradle of the welfare state, which produces immediate reflexes in Brazil. Today, Brazilian democracy is experiencing one of the most serious economic crises in its history, and the labor law, which was excessively protectionist, was considered as one of its main agents. The interdependence of countries imposed on the States the need to flex labor rights, as a compulsory tendency to the growth of the economy of capitalist nations, in order to reduce obstacles to the attraction of investments. Mirroring itself in Europe, Brazil has promoted a major reform in its labor laws, providing greater versatility in the rights, in order to foment the growth of the country. Due to its important social role, the reduction of workers' rights leads to ends other than those intended, such as the increase of social inequalities and the reduction of the social well-being of its citizens. From these assumptions, flexibilization is an inevitable path in the global world, but it will show the close relationship it has with the deconstruction of a well-ordered society, since the principles of freedom and equality must be respected and exercised, as equity.
