Alternative dispute resolution agreements in the countryside of Goiás and the misperception of environmental damage recovering

Resumo: This research analyses the results on damage recomposing in Permanent Preservation Areas located in cities that integrate the Meia Ponte River basin, in Goiás, by verifying the Alternative Dispute Resolution Agreements (ADRs) in which public prosecutors take part in order to evaluate if their work produces sensible results when the ecological role of these areas is considered. The research maps the judiciary districts and links them to environmental crimes committed between 2017 and 2019. By following the established criteria, it analyzes seven ADRs that were found during the research. The goal, during this step, is to examine if the agreements comply with the minimum technical quality required by Brazilian Law. Also, it identifies five rural properties belonging to the ADRs participants in order to verify them by satellite images. These images permit temporal comparison of the areas and make it possible to see if there are Permanent Preservation Areas and Legal Reserved Areas that still have to be recomposed and the proposition on doing so according to the Rural-Environmental Registration. By qualitative analyses, the research concludes that the criteria established by Brazilian Law are not sufficiently complied by the ADRs in which state public prosecutors take part. The results indicate a low utility level of ADRs in Brazil when ecological roles are considered. Important data on the parts, on the areas, and on the obligations are not mentioned or were forgotten. The restoration of the damaged areas was not verified in any of the rural properties analyzed. Public prosecutors value documents over the reality of the areas and the possibility of complying with the ecological role.

Public prosecutors value documents over the reality of the areas and the possibility of complying with the ecological role.Esta investigación analiza los resultados obtenidos en la restauración de los daños ocasionados a las Áreas de Conservación Permanente ubicadas en los municipios que integran la cuenca del río Meia Ponte, en Goiás, a partir de la verificación de los Medios alternativos de resolución de controversias elaborados con la participación del Ministerio Público de Estado con el objetivo de evaluar si la obra produce resultados prácticos acordes con la función ecológica que se espera de estos espacios. La investigación mapea distritos según la cantidad de delitos ambientales registrados entre 2017 y 2019. Siguiendo criterios de selección preestablecidos, analiza siete TAC y prevé el cumplimiento de parámetros mínimos de calidad técnica. Además, identifica cinco predios rurales propiedad de los partidos y evalúa las imágenes satelitales mediante una comparación temporal de la situación de las Áreas de Preservación Permanente y Reservas Legales a ser recompuestas y propuestas en el Registro Ambiental Rural. A través del análisis cualitativo, la investigación concluye que los requisitos definidos por el Derecho no son satisfechos de manera suficiente por los textos formulados por el Ministerio Público. En sus resultados, la investigación indica el bajo nivel de utilidad de los TAC en cuanto a la reanudación efectiva de la función ecológica de las áreas. Falta, o fue olvidada, información relevante sobre los compromisos, sobre la identificación de áreas y sobre las obligaciones contenidas en los acuerdos. En ninguno de los documentos se verificó la restauración de la zona degradada. El Ministerio Público valora más la presentación de documentos que la realidad de la zona y la posibilidad de cumplir la función ecológica.Esta pesquisa analisa os resultados obtidos na recomposição de danos causados a Áreas de Preservação Permanentes localizadas nos municípios que integram a bacia do Rio Meia Ponte, em Goiás, a partir da verificação dos Termos de Ajustamento de Conduta (TACs) elaborados com a participação do Ministério Público estadual, com o fito de avaliar se o trabalho produz resultados práticos condizentes com a função ecológica que se espera desses espaços. A pesquisa mapeia comarcas conforme a quantidade de crimes ambientais registrados entre 2017 e 2019. Seguindo o critério de seleção preestabelecido, realiza análise de sete TACs e dispõe sobre o atendimento de parâmetros mínimos de qualidade técnica. Além disso, identifica cinco imóveis rurais de compromissários e avalia as imagens de satélite por meio de comparação temporal da situação das Áreas de Preservação Permanente e Reservas Legais a serem recompostas e propostas no Cadastro Ambiental Rural. Por meio de análise qualitativa, a pesquisa conclui que os requisitos definidos pelo Direito não são suficientemente atendidos pelos textos formulados pelo Ministério Público. Em seus resultados, a pesquisa indica o baixo nível de utilidade dos TACs quanto à efetiva retomada da função ecológica das áreas. Faltam, ou foram esquecidas, informações relevantes sobre os compromissários, sobre a identificação das áreas e sobre as obrigações consignadas nos acordos. Em nenhum dos documentos foi verificada a recomposição da área degradada.
