The effectiveness of international organizations' decisions from a sovereignty perspective: a proposal for Brazil

Resumo: This study aims to investigate, initially, the concepts of sovereignty, as well as its brief historical evolution, establishing the relationship between democratic constitutionalism and the international bodies responsible for guaranteeing human rights. Once these initial concepts have been established, the paper will analyze the current stage of the debates on the effectiveness of the decisions of international bodies and the procedure for their internalization or reception. Next, this study will analyze the current Brazilian reality, based, for this purpose, on two judgments, one of them selected based on its temporality, therefore, more recent, and the other due to its relevance, both criteria duly outlined in the present article, contextualized with the regional reality. Thus, two distinct methodological approaches are adopted: the first is exploratory, based on the conceptual framework of each of the main objects that involve the issue under analysis, through eminently bibliographical research; and the second, in turn, analytical, observing the Brazilian reality in relation to the decisions of international bodies, based on the aforementioned cases. Ultimately, using the deductive method of scientific research, the article makes it clear that the issue related to the effectiveness of the decisions of international bodies or organizations should be changed in the Brazilian reality. However, due to the discussions presented in the work, especially with regard to sovereignty, the change should occur of lege ferenda, in other words, through political mobilization, by changing the constitution and specific infra-constitutional rules in force.

Una vez establecidos estos conceptos iniciales, el trabajo se propone analizar el estado actual de los debates sobre la eficacia de las decisiones de los organismos internacionales y el procedimiento de su interiorización o recepción. Siguiendo esto, el presente estudio analiza la realidad brasileña actual, basándose, para ello, en dos juicios, uno de ellos seleccionado en base a su temporalidad, por tanto, más reciente, y el otro por su relevancia, ambos criterios debidamente expuestos en este artículo, contextualizados con la realidad regional. Así, se adoptan dos enfoques metodológicos distintos: el primero es exploratorio, precisamente el marco conceptual de cada uno de los principales objetos que envuelven la cuestión analizada, a través de una investigación eminentemente bibliográfica; y el segundo, a su vez, analítico, observando la realidad brasileña en relación con las decisiones de los organismos internacionales, a partir de los casos mencionados. Al final, con base en el método deductivo de la investigación científica, el artículo aclara que la cuestión relacionada con la eficacia de las decisiones de los organismos u organizaciones internacionales debe ser cambiada en la realidad brasileña, sin embargo, debido a las discusiones presentadas por el trabajo, especialmente en lo que respecta a la soberanía, el cambio debe ocurrir de lege ferenda, es decir, a través de la movilización política, con la enmienda constitucional y ciertas normas infraconstitucionales en vigor.O presente estudo tem o objetivo de investigar, inicialmente, os conceitos de soberania, bem como a sua breve evolução histórica, estabelecendo a relação entre o constitucionalismo democrático e os órgãos internacionais responsáveis pelas garantias dos Direitos Humanos. Estabelecidos tais conceitos iniciais, o trabalho se propõe a analisar o atual estágio dos debates acerca da efetividade das decisões de organismos internacionais e o procedimento para a sua internalização ou recepção. Na sequência, este estudo analisa a atual realidade brasileira, baseando-se, para tanto, em dois julgados, selecionados, um deles, com base na temporalidade, portanto, mais recente, e o outro em razão da sua relevância, ambos critérios devidamente delineados no presente artigo, contextualizados com a realidade regional. Assim, duas abordagens metodológicas distintas são adotadas: a primeira exploratória, justamente do enquadramento conceitual de cada um dos principais objetos que envolvem a questão analisada, por meio de uma pesquisa eminentemente bibliográfica; e a segunda, por sua vez, analítica, observando a realidade brasileira em relação às decisões de órgãos internacionais, com fulcro nos casos supramencionados.
