The challenge of Brazilian federalism in the basic sanitation

Resumo: The Article 23 of the Constitution establishes the competences shared by three federated entities, among which is sanitation, a sector that constitutes a challenge to make deliveries, for different reasons. In accordance with Law No. 11,445/2007, sanitation is structured based on a set of services associated with infrastructure and operating facilities. Therefore, it is a service complex that integrates households with collective networks, which have high maintenance costs. At the federal level, sanitation actions are dispersed in a set of institutions that operate in different spatial areas, according to specific criteria. In basic sanitation, the financial autonomy and technical capacity of the municipalities are still insufficient to cooperate with the central government, which makes them technically and financially dependent on the Union. The purpose of this article is to analyze the complex sanitation agreement, at a federal accountability, and to indicate what reflections this architecture has, especially for the municipalities. For this, a literature review was carried out, as well as official documents and databases of the agencies responsible for the sector, within the scope of the Federal Government, and the legislation that regulates basic sanitation was analyzed. This set of resources made possible some findings: a) persistence of a pattern of inequality that occurs vertically, compared to the largest urban centers; b) perpetuation of the sentence by the inspection and control agencies, in view of the technical and institutional weakness, particulary in the smaller cities; c) local managers are refractory to the construction of such systems in view of their cost, which makes them almost incompatible with the finances of the smallest municipalities. These are some aspects that are found in the federal disposition of the sanitation sector, which implies that a considerable part of the population does not have access to this service, especially in the smaller cities.

De acuerdo con la Ley n. 11.445/2007, el saneamiento se estructura a un conjunto de servicios asociados con infraestructura e instalaciones operativas. Es un complejo de servicios que integra a los hogares con redes colectivas, que tienen altos costos de mantenimiento. A nivel federal, las acciones de saneamiento están dispersas en un conjunto de instituciones, que operan en diferentes áreas, de acuerdo con criterios y mandatos específicos. En saneamiento básico, la autonomía financiera y la capacidad técnica de los municipios aún son insuficientes para cooperar con el gobierno central, lo que los hace depender técnica y financieramente de la Unión. El propósito de este artículo es analizar el acuerdo de saneamiento y señalar qué reflejos tiene esta arquitectura, especialmente para los municipios. Se realizó una revisión de la literatura, así como se consultaron documentos oficiales y bases de datos de los organismos del sector, dentro del ámbito del Gobierno Federal y se analizó la legislación que regula el saneamiento básico. Este conjunto de recursos hizo posible algunos hallazgos: a) persistencia de un patrón de desigualdad que ocurre verticalmente, en comparación con los centros urbanos más grandes; b) perpetuación de la pena por parte de los organismos de inspección y control, en vista de la debilidad técnica e institucional, sobre todo en las ciudades más pequeñas; c) los gerentes locales son refractarios a la construcción de tales sistemas en vista de su costo, lo que los hace casi incompatibles con las finanzas de los municipios más pequeños. Esto implica que una parte considerable de la población no tiene acceso a este servicio, especialmente en las ciudades más pequeñas.O artigo 23 da Constituição estabelece as competências compartilhadas pelos três entes federados, dentre as quais está o saneamento, um setor que se constitui em um desafio para efetivar as entregas, por razões diversas. Segundo a Lei n. 11.445/2007, o saneamento se estrutura a partir de um conjunto dos serviços associados à infraestrutura e a instalações operacionais. Logo, trata-se de um complexo de serviços que integra os domicílios a redes coletivas, que têm altos custos de manutenção. No âmbito federal, atualmente, as ações de saneamento estão dispersas em um conjunto de instituições, que atuam em diferentes recortes espaciais, a partir de critérios e mandatos específicos. No saneamento básico, a autonomia financeira e a capacidade técnica das municipalidades ainda se mostram insuficientes para cooperar com o governo central, tornando-se dependentes técnica e financeiramente da União. A proposta do presente artigo é analisar o complexo arranjo do saneamento, em âmbito federal, e apontar que reflexos essa arquitetura tem, especialmente para as municipalidades. Para tanto, houve revisão de literatura, bem como foram consultados documentos oficiais e bases de dados dos órgãos responsáveis pelo setor, no âmbito do Governo Federal, e, complementarmente, foi analisada a legislação que disciplina o saneamento básico. Esse conjunto de recursos possibilitou alguns achados: a) persistência de um padrão de desigualdade que se dá verticalmente, quando comparado a centros urbanos maiores; b) perpetuação da penalização pelos órgãos de fiscalização e controle, em face da fragilidade técnica e institucional, principalmente nas menores cidades; c) os gestores locais se mostram refratários a construir tais sistemas em face do seu custo que os torna quase incompatíveis com as finanças dos menores municípios.
