This dissertation objectified reflect on the judicial view the adoption for trans* people. First it started with theoretical discussions about family, adoption, gender, and the judicialization of life. As ambience to make this project was used two Forums southern Paraná central region, glimpsing capture different looks in more than one county. The target audience were two promoters, two judicial technicians and a judge, in order to analyze the speeches that contribute to form or prevent the construction of a family by transvestites and transsexuals through from adoption. To meet this goal, It sought to identify who are the actors involved in the process and investigate how they are promoting their judicial decisions. The problem of study considered the mobilizations concerning the struggle for the rights and empowerment of transvestites and transsexuals that are happening in our country, with the central question of this research, the perception of the judiciary on the adoption by transvestites and transsexuals in cities in the region south central of Paraná state. The methodology used was the qualitative research being supported the semi-structured interviews for the treatment of this information was used discourse analysis technique. The narratives presented demonstrated the lack of laws that prohibit or hinder the access of transvestites and transsexuals to foster parenting, but we realize that there are speeches denouncing how personal beliefs interfere in the professional and consequently in judicial decisions. In this sense we must consider the importance of studies and research in the area, with a view that all change for justice and equality begins when we understand better who are the other people, and they live, overcoming myths and fears.
