Resumo: When it comes to death, the uncertainty of how life will end scares many, because it's terrible. think about how we humans will die. The present work has for purpose of treating the Vital Testament as the Advance Will Directive with a view to importance of the theme in our Brazilian legal system. Moreover, it does not exist in our legal system law regulating and discipline regarding advance directives of will: living will. This institute takes care in its essence of the conscious choice of the person, before of being unable by chronic disease, whether or not to undergo medical treatment, that instead of easing suffering, they would only prolong the days of suffering. Tour this, was also approached in the work, succinctly the legitimate and testamentary succession, given the importance of the study to understand that the living will is not synonymous of the succession will.

O presente trabalho tem por objetivo tratar do Testamento Vital como Diretiva Antecipada de Vontade tendo em vista a importância do tema em nosso ordenamento jurídico brasileiro. Ademais, não existe em nosso sistema jurídico lei que regulamente e discipline acerca das diretivas antecipadas de vontade: testamento vital. Esse instituto cuida em sua essência da escolha consciente da pessoa, antes de estar impossibilitado por doença crônica, em se submeter ou não a tratamentos médicos, que ao invés de amenizar o sofrimento, apenas prolongariam os dias de sofrimento.
