Special Social Security Regime:: normative evolution in Brazil and in Ceará

Resumo: Brazil has undergone successive changes in social security legislation since the 1990s and this leads todivergences in the various stakeholders’ perception regarding a complex theme that involves the past, present, and future. The current focus of normative changes in the Special Social Security Regime (Regime Próprio de Previdência Social [RPPS]) is the financial deficit of federal entities. However, social security has a worldwide history that dates back to the Middle Ages; in Brazil, it started embryonically in 1795, but it only arrived at our Constitution in 1934. The major milestone in the defense of social rights occurred with the 1988 Federal Constitution. The last changes took place in 2019, with the approval of new rules for retirement and pension benefits. The State of Ceará has a deficit in its RPPS and it is in line with the pension management policy of Constitutional Amendment No. 103, enacted in 2019. Given this context, this research aimed to analyze the normative evolution of the RPPS in Brazil and in the State of Ceará, within the period from 1934 to 2019. The research used a qualitative and historical methodology, with a bibliographic and documentary design, resorting to content analysis of standards and regulations. It was found that, from 1998 on, the State of Ceará is increasingly aligned with federal legislation.

El foco actual de cambios en la normalización del Régimen Próprio de Previdência Social (Regime Próprio de Previdência Social [RPPS]) es el déficit financiero de las entidades federativas. Sin embargo, la seguridad social tiene una historia mundial que se remonta a la Edad Media; en Brasil, se inició embrionariamente en 1795, pero solo llegó a nuestra Constitución en 1934. El gran hito en la defensa de los derechos sociales se produjo con la Constitución Federal de 1988. Los últimos cambios se produjeron en 2019, con la aprobación de nuevas reglas para los beneficios de jubilación y pensión. El Estado de Ceará tiene un déficit en su RPPS y está en línea con las políticas de gestión de seguridad social de la Enmienda Constitucional No. 103, promulgada en 2019. En este contexto, esta investigación tuvo como objetivo analizar la evolución normativa del RPPS en Brasil y en el Estado de Ceará, en el período de 1934 a 2019. La investigación utilizó una metodología cualitativa e histórica, con un diseño bibliográfico y documental, recurriendo al análisis de contenido de normas y reglamentos. Se constató que, a partir de 1998, el Estado de Ceará está cada vez más alineado con la legislación federal.Le Brésil a connu des changements successifs de la législation sur la sécurité sociale depuis les années 1990,ce qui génère des divergences dans la perception des différentes stakeholders sur un thème complexe quiimplique le passé, le présent et l’avenir. Le point central actuel des changements dans la normalisation duRégime Spécial de Sécurité Sociale (Regime Próprio de Previdência Social [RPPS]) est le déficit financier desentités fédératives. Cependant, la sécurité sociale a une histoire mondiale qui remonte au Moyen Âge; au Brésil, il a commencé à l’état embryonnaire en 1795, mais il n’est arrivé à notre Constitution qu’en 1934. Le grand jalon dans la défense des droits sociaux s’est produit avec la Constitution Fédérale de 1988. Les derniers changements ont eu lieu en 2019, avec l’approbation de nouvelles règles relatives aux prestations de retraite et de pension. L’État du Ceará a un déficit dans son RPPS et il s’aligne sur les politiques de gestion sur la sécurité sociale de l’Amendement Constitutionnel No. 103, promulgué en 2019. Dans ce contexte, cette recherche visait à analyser l’évolution réglementaire du RPPS au Brésil et au l’État du Ceará, dans la période de 1934 à 2019. La recherche a utilisé une méthodologie qualitative et historique, avec une conception bibliographique et documentaire, recourant à l’analyse du contenu des normes et des réglementations. O enfoque atual das mudanças na normalização do Regime Próprio de Previdência Social (RPPS) é o déficit financeiro dos entes federativos. No entanto, a previdência social tem uma história mundial que remonta à Idade Média e no Brasil, começou embrionariamente em 1795, mas só chegou à Constituição em 1934. O grande marco da defesa dos direitos sociais ocorreu com a Constituição Federal (1988). As últimas alterações ocorreram em 2019, com a aprovação de novas regras para os benefícios de aposentadoria e de pensão. O Estado do Ceará está com o RPPS deficitário e está alinhado com as políticas de gestão previdenciária da Emenda Constitucional n. 103 (2019). Diante desse contexto o objetivo da pesquisa é analisar a evolução da normalização do RPPS no Brasil e no estado do Ceará, no período de 1934 a 2019.
