Points of view and responsability enunciated in a judicial sentence regarding the publication of intimate photos in Whatsapp group

Taking as a corpus a judicial sentence related to revenge pornography, we propose, in this article, to analyze the textual-discursive strategies revealing the movements of (non) assumption of the enunciative responsibility of the points of view and the relation of these strategies with the construction of the argumentative dimension. The theoretical contribution comes mainly from the works of Adam (2010; 2011; 2017; 2019), located in the theoretical-methodological framework of Textual Analysis of Discourses (ATD). We also use the Enunciative and Pragmatic Approach of Points of View proposed by Rabatel (2016a; 2016b), to discuss enunciative responsibility and the points of view, and to the Theory of Argumentation in Discourse, based on Amossy (2018), to discuss about the argumentative dimension of the text. The sentence that constitutes the corpus of analysis was collected on the website of the Justice Court of São Paulo - Judiciary, and its content is the publication of intimate photos in a WhatsApp group. In the context in question, the plaintiff, a woman, claims compensation for moral damages, for having been the victim of revenge pornography by an ex-boyfriend. In the data analysis, we demonstrate, through the examination of different linguistic marks mobilized in the text (verb tenses, modalities, types of speech representation, among others), how the main enunciative instance, the judge, manages the points of view, assuming them or refuting them, to argumentatively demarcate their position in favor of the woman defendant's initial petition and in disagreement with the man defendant's counter-response.
