Resumo: A reflection on “homophobia” versus “freedom of expression”, with a bias towards identifying the boundary line between each one, constitutes the theme of this work, which is based on a qualitative research approach, from a literature review perspective. The aim is thus to consider which rights are in conflict and whether one should overlap the other. The study proposes to bring elements that can characterize the practice of homophobia or simply the issue of opinion within the contours of the Constitution of the Republic, as both the expressions of sexuality and the verbalization of thought are inseparable to human beings and both have the “status” of fundamental right, it being up to the State and society to equate the issue to guarantee the regular exercise of each one.

Busca-se assim ponderar quais direitos estão em confronto e se um deve se sobrepor ao outro.
