The temporal Framework for the demarcation of indigenous lands, memory and forgetfulness

Resumo: Indigenous peoples today have constitutionally guaranteed the original right to the lands they traditionally occupy, endorsing the indigenous institute. However, the Federal Supreme Court has been restricting this right by establishing the so-called temporal framework for demarcation of indigenous lands and, more recently, the Executive with the approval of the AGU Opinion, which intends to link the entire Federal Public Administration to this understanding. These actions go against the conclusions of the National Truth Commission, which pointed to a systematic framework of forced removals and evictions in the previous period of the 1988 Constitution, and neglect transitional mechanisms for the restoration of truth and the redemption of memory, representing the implementation of an “Oblivion policy” by the Brazilian State.

No entanto, o Supremo Tribunal Federal vem restringindo esse direito ao estabelecer o chamado marco temporal para demarcação das terras indígenas e, mais recentemente, o Executivo com a aprovação do Parecer da AGU, que pretende vincular toda a Administração Pública Federal a esse entendimento.
