Resumo: | The art. 190 of New Civil Procedure Code is an innovation, in that it authorizes the parties to enter into non-typical procedural legal transactions. The intention of the legislature, it seems, was to honor the principle of respect for self-preservation of the will in the process as unfolding of the principle of freedom, and also the principle of cooperation, laid down in art. 6.º of the New Code and which is presented as a fundamental norm of civil proceedings. Thus, the present study proposes to analyze precisely these two principles, which can be understood as the basis of the institute. The method adopted will be the deductive method. |

Assim, o presente estudo se propõe à análise justamente destes dois princípios, que podem ser compreendidos como a base principiológica do instituto.
