Consumer protection in the transnational context: the importance of integrational standardization according to an analysis of the European Union and the Mercosur block

Resumo:  This study the grassroots level has main analyse model protection legal the consumer in the EU block and compares it to the Mercosur model. While Mercosur is still developing in the international arena, it is the diplomatic initiative of deeper cooperation occurred between the countries that comprise it, with no way to avoid its leading role in today's Latin American policy. It is intended to show that consumer protection within Mercosur is incipient because, despite the States Parties have formally pledged to harmonize their laws within the consumer, still applies the domestic legal system of each country. To this end, the European model is an inspiration to reveal matching methods of legislation and facilitate the elimination or at least reduction of the possible asymmetries between the legal systems of States. Thus, demonstrating the feasibility of a minimum legislative harmonization, enabling mitigate or eliminate asymmetries effectively and recognizing an equal consumer protection throughout Mercosur.

Embora o Mercosul ainda esteja se desenvolvendo no cenário internacional, trata-se da iniciativa diplomática de cooperação mais profunda ocorrida entre os países que o compõem, não havendo como evitar o seu papel de destaque na atualidade da política latino-americana. Pretende-se mostrar que a proteção do consumidor no âmbito do Mercosul é incipiente, pois, não obstante os Estados-partes tenham formalmente se comprometido a harmonizar suas legislações, no âmbito do consumo, ainda se aplica o ordenamento jurídico interno de cada país. Para tanto, o modelo europeu serve de inspiração a revelar métodos de harmonização da legislação e propiciar a eliminação ou, pelo menos, redução das possíveis assimetrias existentes entre os ordenamentos jurídicos dos Estados.
