THE LEGAL PLURALISM AND ITS IMPACT ON CONTEMPORARY CRIMINAL LAW

Resumo: Legal pluralism is now an undisputed reality in humancivilization, especially after the phenomenon of globalization,technological expansion and the migratory flow resulting from integration between countries. This advent brought consequencesfor the world of law, rethinking legal monism in order toimplement new and different forms of conflict resolution within and outside the borders of a state, from which intra and extra-state legal pluralism comes. Undoubtedly, legal pluralism was driven by recognition and respect for differences, accentuated inthe last quarter of the 20th century, from social movements thatdemanded the promotion of identity rights related to minorities,giving rise to an identity policy, being essential a multiculturalmanagement of this novel society. The hypothesis of this researchis that Law has reinvented itself in this context, as a normativesystem open to the influences of this contemporary reality, with amore discursive and prospective and less dogmatic bias, havingan impact on all its branches, such as Criminal Law, as was laterconfirmed. The aim of this article is to uncover new possibilitiesfor understanding Law, highlight other legal sensitivities forconflict resolution, this being an exploratory and documentalresearch, with a view to exploring the new possibilities arisingfrom legal pluralism.

Tal advento trouxeconsequências para o mundo do Direito, repensando o monismojurídico de modo a implementar novas e diferentes formasde resolução de conflitos dentro e fora das fronteiras de umEstado, de onde advém o pluralismo jurídico intra e extraestatal.Indubitavelmente, o pluralismo jurídico foi impulsionadopelo reconhecimento e o respeito às diferenças, acentuado noúltimo quartel do Século XX, a partir de movimentos sociaisque exigiam a promoção de direitos identitários relacionadosàs minorias, dando origem a uma política de identidade, sendoindispensável uma gestão multicultural desta novel sociedade.A hipótese dessa pesquisa é que o Direito se reinventou diantedesse contexto, como um sistema normativo aberto aos influxosdesta realidade contemporânea, com um viés mais discursivoe prospectivo e menos dogmático, tendo reflexo em todos osseus ramos, a exemplo do Direito Penal, como posteriormentefoi confirmado.
