“Fake news”, freedom of expression information and democracy: : perspectives and strategies to combat (mis) information

Resumo: The phenomenon of untrue news, “fake news”, however is not recent, has increased considerably due to the massif cation of social networks. In this context, this article seeks to analyze the outlines of this phenomenon, its role in the virtual media network, as well as its implications for the fundamental humanrights of freedom of expression and information in the context of contemporary democracies. The objective is to understand day-to-day dissemination of “fake news” contributes to misinformation and polarization in society, as well as to the destabilization of democratic regimes. In addition, it intends to show what the mechanisms and strategies aimed at combating “fake news” are and what they can be, with a view to guaranteeing the preservation of fundamental human rights. It adopts the deductive method of approach and the technique of bibliographic research, through data collection, through a qualitative analysis of the topic at hand. The analysis concluded that both “fake news” lead to harmful effects and do not favor the promotion of an inclusive and pacifist society, considering that they exceed and, therefore, violate the fundamental human rights to information and the right to freedom of expression.

Nesse contexto, o presente artigo busca analisar os seus delineamentos, a sua atuação na rede midiática virtual, bem como as suas implicações aos direitos humanos fundamentais da liberdade de expressão e informação no âmbito das democracias contemporâneas. O objetivo é compreender como a disseminação diuturna das “fake news” contribuem à desinformação e à polarização na sociedade, assim como à desestabilização dos regimes democráticos. Além disso, pretende evidenciar quais são e quais podem ser os mecanismos e as estratégias utilizadas por instituições nacionais e internacionais com vistas a garantir a preservação dos direitos humanos fundamentais e a democracia por meio do combate à desinformação. Adota-se o método dedutivo de abordagem e a técnica de pesquisa bibliográfica, por meio do levantamento de dados, por meio de uma análise qualitativa acerca do tema em tela.
