Resumo: This article proposes an approach about environmental instrumental rights in accordance with the Escazú Agreement. It is sustain that the international agreement provides a new approach of environmental information access law. The information law assumes the function of to subsidize the government, market and society in order to definite alternatives and decisions make into the energy demands framework. In this background, it’s task of government and market agents to elaborate databases and elements in favor of to enlarge knowledges and potentialities of sustainable energies, in special, of biomass energy. The biomass energy potentiality is underused in Brazil. The enlargement of biomass energy use depends of information access as a way to construct sustainable social-economics alternatives for energy production. From critical propositive method, the article sustain that Escazú Agreement is a way to promote biomass as sustainable energy and in favor of overcoming of operational deficits in its legal framework.

Sustenta-se que o Tratado Internacional propicia uma nova formulação do direito ao acesso à informação ambiental. O direito à informação assume o papel de subsidiar Estado, mercado e sociedade para a definição de alternativas e tomadas de decisão no quadro de demandas energéticas. Nesse pano de fundo, cabe ao Estado e aos agentes de mercado elaborarem bases de dados e elementos para ampliação do conhecimento e potencialidades de energias sustentáveis, em especial, da biomassa. O potencial de biomassa é subutilizado no Brasil. A ampliação do uso de biomassa depende do acesso à informação como via para construção de alternativas socioeconômicas sustentáveis para produção de energia.
