Dialogue between cuts: complementarity of the ISHR in the institutional protection of LGBTI+ people

Resumo: The combination of the legislative omission to imple-ment the constitutional and conventional command to criminalize homotransphobia with the conjuncture of violence against LGBTI+ people or those identified as such gave rise to the filing of the Direct Action of Unconstitutionality for Omission n. 26 / DF and Injunction Order no. 4733. The Supreme Federal Court, when considering the case, decided to recognize the unconstitutional omission and determined the application of Law no. 7.716 / 89, as well as art. 121, §2o, I, of the Penal Code. Thus, the research has the general objective of analyzing the essentiality of the interaction between the various organs of the inter-American system for the effective institutional protection of minorities or groups in situations of sexual vulnerability. To test the hypothesis, bibliographical and documentary research and the hypothetical-deductive method are developed. It is concluded that the construction of the concept of racism was the dialogical and interpretative way to “criminalize” the homotransphobic discriminatory practice.

O Supremo Tribunal Federal, ao apreciar a causa, decidiu por reconhecer a omissão inconstitucional e determinou a aplicação da Lei n. 7.716/89, assim como do art. 121, §2º, I, do Código Penal. Assim, a pesquisa tem como objetivo geral analisar a essencialidade da interação entre os diversos órgãos do sistema interamericano para a efetiva proteção institucional das minorias ou dos grupos em situação de vulnerabilidade sexual. Para testar a hipótese, desenvolve-se pesquisa bibliográfica e documental e do método hipotético-dedutivo.
