The Constitution of the Federative Republic of Brazil of 1988 configures an important mark for democracy, moreover by the adoption of productive pluralism in its Economic Constitution. It, in turn, permits state intervention in the economic domain, such, as by, price controls (genre). Accordingly, the article seeks tohighlight state intervention by means of minimum price (species), within the constitutional framework, contemplating the case ofthe “Freight Tables” instituted after the truck driver’s movement, in May 2018, which culminated in the Provisional Measure no 832/2018, converted into the Law no 13.703/2018, and resulted in the judicial inquiry of the so-called interventionist sectoral economic policy, by way of the Direct Unconstitutionality Actions (ADIs)nos 5956/DF, 5959/DF and 5964/DF, before the Federal SupremeCourt. Research was documentary and further bolstered by legal doctrine, national legislation and judicial decisions, having as its theoretical framework the lessons of the jurist from Minas Gerais, Washington Peluso Albino de Souza, regarding state intervention in the economic domain.
