Resumo: This work was initial concern to bring the concepts of freedom in natural law vision of John Locke and Rousseau in democratic construction, which creates a clash of constitutional principles of freedom and equality. Then, it analyzes these theories of Habermas's conception, in which freedom is expressed here by choosing different types of rationales for action, which reveals a tension between the action -oriented consensus or instrumentality. With this, we turn to Habermas' concept of law, which will facilitate overcoming the conflict between freedom and equality, since both pass coexist without contradiction.

Posteriormente, analisa estas teorias sobre a concepção habermasiana, no qual a liberdade aqui se expressa pela escolha de diferentes tipos de racionalidades para a ação, o que revela uma tensão entre a ação orientada para o consenso ou para a instrumentalidade.
