Resumo: This article, through a methodological analysis of the doctrine, laws and jurisprudence, aims to throw a look at the economic regulation carried out by the Brazilian State and the insurgent struggle against the abusiveness and inequalities of the private economic interest and the political legality of a social state in their obligation to achieve the common good. This clash was publicized in public-private economic scandals, having as a background an inclusion of the country in the paths of globalization, which was emphasized in the Brazilian economy from the 90's and was represented in a single aspects by the capital accumulation of certain subjects and their fluency through the intricacies of the country internal and external economy. This globalization also motivated the adaptation of the Brazilian State to a new world reality of open markets. Inserting it into a world without physical boundaries, forcing the Brazilian state to adapt legally, politically and socially to a new world order that is more predatory and, essentially, capital accumulating.

Políticas de industrialização, infraestrutura, de estabilização econômica, controle inflacional e políticas sociais sucumbiram ao tempo e a globalização. Entretanto, a base do capital Liberal perseverou sobre todos os regimes e épocas da modernidade, favorecendo o progresso, mas, também, acumuladores de capital, investidores oportunistas e a corruptores e corruptos. O sistema político deixou-se levar pelo capital em uma crescente necessidade de progresso e modernização o que motivou, por outro lado, uma corrente de oportunismo financeiro montado sobre o capital publico e privado.
