Resumo: In this analysis exercise we seek to understand the constitution of the universal subject and its discursive functioning, through two human rights documents: the Declaration of the Rights of Man and of the Citizen (1789) and the Universal Declaration of Human Rights (1948). Through the notions of discursive formation, forgetfulness and preconstructed (PÊCHEUX, 2009 [1975]), we found that the illusion of full inclusion, there is a serious discourse contradiction that the universal subject of human rights is not presented as apparently universal as these statements say.
