Postnational law: a study on the protection of legal affairs in the face of the crisis of the national states

Resumo: National states have lost competitiveness in the faceof globalization and digital communication. In this context, thereis a need to overcome this crisis, as well as to make a new reading about legal affairs, which takes into account the dignity ofthe human person and democratic principles. Habermas, in ThePost-National Constellation, in view of the self-limitation ofstate attributions, suggests as a possible response the formationof global mergers, of Global States, for the recovery of state political force and sovereignty itself, internally and external. AndMarcelo Varella seeks to respond to crises from an internationalperspective by creating a post-national law. This paper hypothesizes that a post-national law, based on the organization of globalblocs and institutions of international strength and sovereignty, will serve as a response to the crisis of national states andstrengthen a democratic reading of legal affairs. Through a bibliographic and exploratory methodology, a post-national readingis made in the scenario of global constitutionalism.

Nesse âmbito, urge a necessidade de superar essa crise, bem como de realizar uma nova leitura acerca dos negócios jurídicos, que leve em consideração a dignidade da pessoa humana e os princípios democráticos. Habermas, em A constelação pós-nacional, em vista da autolimitação das atribuições estatais, sugere como possibilidade de resposta a formação de fusões em âmbito mundial, de Estados Globais, para a recuperação da força política estatal e da própria soberania, em âmbito interno e externo. Assim, este artigo tem como hipótese que um direito pós-nacional, calcado na organização de blocos globais e instituições de força e soberania internacionais, sirva de resposta à crise dos Estados Nacionais e fortaleça uma leitura democrática dos negócios jurídicos.
