Alternative solutions for urban land conflicts as a way to realize the social right to housing

Resumo: The objective of this work is to analyze alternative solutions for resolving land conflicts, starting from the question whether the current procedural system is sufficient for resolution and the purpose of ensuring the social right to housing. In this sense, the starting point is the study of procedural institutes and negotiation techniques that can be used in conflict, so that when resolution is achieved, the change of social facts constitutionally recognized as social rights can be achieved. In this area, the positive action of the State, through its agents, is necessary and in cases of processes that go beyond the individual sphere, procedural protection requires improvement in this reality. It is qualitative research, with a deductive method, with an exploratory base and bibliographical survey, to print critical cognition to the sources.

Nesse sentido, parte-se do estudo dos institutos processuais e das técnicas de negociação passíveis de aplicação nessa espécie de conflito, para que quando alcançada a resolubilidade possa ser alcançada e configurada a mudança de fatos sociais constitucionalmente reconhecidos como direitos sociais. Nesta seara, a atuação positiva do Estado, por intermédio dos seus agentes faz-se necessária e em casos de processos que ultrapassam a esfera individual, a tutela processual requer adequação a essa realidade.
