Privacy and data protection in nosocomios and clinics before the LGPD

This article aims to identify the most appropriate forms of data protection, guaranteeing the privacy of the holders of such data, as well as the legal provision that permeates this situation of guaranteeing privacy and data protection, based on the Federal Constitution, and in the application of infraconstitutional laws, especially aimed at the proper documentation of nosocomios, clinics and patients. In terms of the methodology used, bibliographic searches and secure sources of valid content were carried out, with compelling information. The study concluded that privacy and data protection is not yet fully guaranteed even in legislation, let alone in nosocomios and clinics, despite the existence of legislation providing, so that there is a minimum guarantee, at least, of the privacy of citizens and their data which, in the hands of ill-intentioned third parties, may cause unimaginable and drastic upheavals. In addition, what is verified is that the same individuals who treat and care for patients hospitalized in nosocomios and clinics, are the ones who feed and post the data in the system, where, due to the high stress and pressure of the daily life of work, may make mistakes or fail to pay attention to the security of the necessary data and information.
