Resumo: The conflict is a constant natural present in the socialenvironment, especially in contemporary society on groundsof complexity present in human individuality, in the psyche ofthe human being. In this path, discusses whether the mediationproposal by Luis Alberto Warat can be used as a tool able tohumanize the social conflicts. Such questions arise due to theinadequacy of judicial procedure in the treatment of conflictsand increased litigation and non-social pacification. Therefore,the goal is with the use of mediation in the Democratic State toachieve social peace and humanization of the conflict from the understanding of another individual, as well as of their particularitiesand needs. To this end, the research used the descriptive analyticalmethod.

Nessa senda, discute-se se a mediação proposta por Luis Alberto Warat pode ser utilizada como uma ferramenta apta a humanizar os conflitos sociais. Tais questionamentos surgem em razão da inadequação do procedimento jurisdicional no tratamento dos conflitos e do aumento da litigiosidade e da não pacificação social. Assim, objetiva-se com a utilização da mediação no Estado Democrático a concretização da pacificação social e a humanização dos conflitos a partir da compreensão do outro indivíduo, bem como de suas particularidades e necessidades.
