A gestão do cuidado ao idoso na perspectiva dos direitos instituídos

Resumo: The increase of older population in Brazil is reflecting in socioeconomic changes which affect the way of society living. In addition to these changes, the country is going through a demographic and epidemiologic transition that contributes to alterations on health standards, and social and health assistance, that increase demands for hospitalization and medical care at the public health services by elderly are highlighted. For optimization of elderly care, the nursing staff, in addition to technical and scientific skills, must base its actions in ethical principles and legal precepts aiming fulfilling their rights. This study was undertaken with the purpose of verifying if the expectations and rights of elderly patient are being met by current laws. It is a descriptive exploratory study of quantitative approach, carried out at a school-hospital and a city hospital, both exclusive of Single Health System, located in the Northwestern of Paraná State. The research was approved by the Committee of Ethics in Research of a state university, according to Resolution 196/96 of CNS/MS (Brazil, 1996). The observation of the patients' rights by nursing staff was analyzed through a home-applied questionnaire, after hospital dismiss, to the 24 patients that comprised the sample. In the questionnaire, issues concerning the socioeconomic characteristics, attendance to the patients? rights concerning information provided by nursing staff, respect towards personal values, rights for an accompanying, secrecy and spiritual support, and their expectations towards the nursing attendance were included. According to the results, 16 (66.7%) elderly were female; the greatest proportion of widows was among women; 13 (54.2%) of the elderly could not read or write. As for living conditions, 12 (50%) owned their homes and lived with family members, and 12 (50%) had incomes of one minimum salary, often coming from retirement. It was observed that the patients rights concerning information and autonomous decision-making relative to their treatment are not frequently met neither appropriately by nursing staff. As for respect towards personal values, some habits were maintained, but rules and routines of hospital are first-place. As for nursing assistance, most of them reported that were well cared of, and when a criticism was raised it was soon compensated by some kind of congratulation. Nineteen (79.2%) of the elderly had an accompanying, five (20.8%) did not have this support because their family members had to work. None of the patients asked for secrecy about any fact or spiritual support but even in that case four (16%) received a religious visit while in hospital. As for expectations of patients concerning the attendance by nursing staff, they expect to be treated with attention, tenderness and respect. Despite the elderly not expressing much criticism, it was perceived unfavorable opinions about received care. It was concluded in the hospitalization context that elderly rights are not very well respected by nursing staff.

Além dessas mudanças, o país passa por uma transição demográfica e epidemiológica que contribui para alterações nos padrões de saúde, e no seu sistema de atenção, destacando-se o aumento da demanda e no tempo de hospitalização, também o aumento das consultas na rede básica entre os idosos. Para a otimização da gestão do cuidado ao idoso, a essa clientela, a equipe de enfermagem, além da competência técnica e científica, deve embasar o seu cuidar em princípios éticos e preceitos legais que visam o cumprimento dos seus direitos. Com a finalidade de verificar o atendimento das expectativas e direitos do paciente idoso, por meio da legislação vigente, é que se realizou o presente estudo. Trata-se de um estudo descritivo exploratório de abordagem quantitativa, realizado no período de fevereiro a abril de 2006 em um hospital-escola e em um hospital municipal, ambos de atendimento exclusivo do Sistema Único de Saúde, localizados na região noroeste do Estado do Paraná. A pesquisa foi aprovada pelo Comitê de Ética em Pesquisa de uma universidade estadual, em conformidade com a Resolução 196/96 do CNS/MS (BRASIL, 1996). O atendimento aos direitos do paciente pela equipe de enfermagem foi analisado, através de um questionário aplicado em domicílio, após a alta hospitalar dos 24 pacientes que fizeram parte da amostra. No questionário, foram contemplados assuntos relacionados às características socioeconômicas, ao atendimento dos direitos do paciente em relação às informações fornecidas pela equipe de enfermagem, direito ao respeito a valores pessoais, direito a acompanhante, a sigilo e a apoio espiritual e suas expectativas em relação ao atendimento de enfermagem. De acordo com os resultados, 16 (66,7%) idosos eram do sexo feminino, a maior porcentagem de viuvez esteve entre as mulheres, 13 (54,2%) idosos não sabiam ler nem escrever. Em relação à moradia, 12 (50%) dos entrevistados possuíam casa própria e moravam com membros da família, 12 (50%) deles têm renda familiar de um salário mínimo. Essa renda, geralmente, advém da aposentadoria. Constatou-se que os direitos dos pacientes relacionados à informação e autonomia nas decisões em relação a seu tratamento não são atendidos freqüentemente e nem adequadamente pela equipe de enfermagem. Em relação ao respeito a valores pessoais durante a hospitalização, alguns hábitos foram mantidos, porém foram priorizadas as normas e rotinas das instituições hospitalares. Sobre a assistência de enfermagem, a maioria relatou que foi bem atendida e quando realizavam alguma crítica, logo procuravam justificá-la com algum elogio. 19 (79,2%) idosos referiram que tiveram acompanhante, cinco (20,8 %) não tiveram esse tipo de suporte devido à necessidade dos familiares trabalharem. Nenhum paciente solicitou sigilo sobre algum fato ou apoio espiritual, apesar disso, quatro (16,7%) referiram ter recebido visita religiosa enquanto internados. Quanto às expectativas do cliente, em relação ao atendimento de enfermagem, relaciona-se com: ser tratados com atenção, carinho e respeito. Apesar de os idosos não terem apontado muitas criticas, percebeu-se que existem opiniões desfavoráveis ao cuidado recebido.
