Resumo: | The development of any country is linked to supply and conditions of existing infrastructure. The energy input is a high spread in all types of productive activities. In particular, the structure of governance of the energy sector depends on the rules of engagement established by the countries. Search is based on institutional theory to understand the process of evolution of the Brazilian electric sector, centralization that began in the 30s the decentralization of the 90s, as well as changes in the structure of governance. The institutional theory to show that institutions have an important role in economic development, where a set of political institutions and economic efficiency results in lower transaction costs and consequently, in product and factor markets more efficient. In the Brazilian electric sector, the regulatory model is the mechanism by which it maintains the balance of interests of organizations that work in this sector, and this happens from the balance between its internal logic and its external environment, thus providing favorable conditions for the production, transmission and distribution of energy, and for the benefit of society. Consequently, understanding the evolution of the Brazilian electric sector, the decentralization process and training of regulatory agencies, and the resulting structure of governance, it is important. A energia é um insumo de alta difusão no conjunto de todas as atividades produtivas. Em particular, a estrutura de governança do setor energético depende das regras de contrato estabelecida pelos países. Procura-se, apoiado na teoria institucional, compreender o processo de evolução do setor elétrico brasileiro, da centralização que se iniciou na década de 1930, da descentralização da década de 1990, bem como as mudanças ocorridas na estrutura de governança. A teoria institucional procura mostrar que as instituições têm papel importante no desenvolvimento econômico, em que um conjunto de instituições políticas e econômicas eficiente implica menores custos de transação e, consequentemente, mercados de produtos e fatores mais eficientes. No setor elétrico brasileiro, o modelo regulatório é o mecanismo pelo qual se mantém o equilíbrio de interesses das organizações que atuam neste setor e, este se dá, a partir do balanceamento entre a sua racionalidade interna e o seu ambiente externo, para, assim, proporcionar condições favoráveis à produção, transmissão e distribuição de energia e para o benefício da sociedade. Consequentemente, entender a evolução do setor elétrico brasileiro, o processo de descentralização e a formação das agências reguladoras, bem como a estrutura de governança resultante se torna importante. A estrutura de governança do setor elétrico brasileiro sofreu diversas alterações no decorrer de pouco mais de um século, refletindo o pensamento institucional mundial e nacional de cada período de sua história. A governança do setor elétrico brasileiro atualmente apresenta estrutura híbrida, com a descentralizada das decisões tomadas no setor, com a ANEEL encarregada da fiscalização e regulamentação, bem como a mediação de conflitos. A ANEEL conta com agências estaduais de fiscalização, Conselhos de Consumidores, SBDC, CONAMA, MMA, SNRH e ANA, como órgãos auxiliares na execução de suas funções, mas sujeitas aos interesses do Estado.
