Resumo: Marsilio Mainardini, called Marsilius of Padua, jurist and studious of politics was born in Padova, Italy, around the year 1280 and lived until 1343. His father was an important jurist at the prestigious University of Padua. He studied Law in his hometown, that was an outstanding juridical culture center of that time. He was influenced by Aristotle’s Philosophy, a fact that can be verified on his work: Defensor pacis (1324) in which he exposed a political philosophy delineated by the construction effort of a State notion (or government) free from the arbitraryties of the Roman pontifical court (and from Avignon). His concept of popular sovereignty contributed for secularization of the State and the Power, as an anticipation of the Political Modernity, built from the 16th century. The text focus more details on the concept of power through the analysis of its State civil organization model and also, the author’s rejection to ecclesiastical interferences on civil governments. The edition of Defensor of Peace, which is used in this paper, is the Brazilian translation from 1994

Filho de um notário da prestigiada Universidade Patavina, estudou Direito em sua cidade natal, notável centro da cultura jurídica da época. Ele foi grandemente influenciado pela filosofia aristotélica, fato que pode ser verificado em sua obra: Defensor pacis (1324) na qual expôs uma filosofia política delineada pelo esforço de construção de uma noção de Estado (ou governo) livre das arbitrariedades da corte pontifical de Roma (ou de Avinhão). Seu conceito de soberania do povo contribuiu grandemente para a laicização do Estado e do Poder, numa antecipação da Modernidade Política, construída a partir do século XVI. O texto enfoca mais detalhadamente seu conceito de poder por meio da análise do modelo de organização civil do Estado e também de seu repúdio às ingerências eclesiásticas sobre os governos civis.
