THE EXTRAJUDICIAL ACTIVITIES OF THE OUTSIDER JUDGES OF VILA DO CUIABÁ (1767-1796)

Resumo: The introduction of the role of the juiz de fora (herein referred as outsider judge, a literal translation) represents an effort from the Portuguese Crown to scrimp the power of local elites. This magistrate would take over the presidency of Municipal Chambers when in attendance to that locality. Besides, outsider judges in the Portuguese America would incorporate several other roles attached to their jurisdiction. At Vila Real do Cuiabá, magistrates would perform administrative duties that went beyond Justice, such as the maintenance of the Royal Storage and sending supplies and ammunition to the military villages on the Paraguay River. The detailing of administrative activities, on the other hand, can be found in letters sent by outsider judges to governors, established in the capital, Vila Bela. Such sources are currently stored in the Public Archives of Mato Grosso (APMT). This correspondence constitutes an important piece for greater knowledge on the administrative routine of the village, on the role of outsider judges, and on their spaces of power within the body of authorities of the captaincy. Our aim with this articles is, therefore, to analyze the content of such letters, giving special attention to the extrajudicial roles performed by the outsider judges of Vila do Cuiabá, as well as their relationship with the governors of the Mato Grosso captaincy between the years of 1767 and 1796. From a theoretical perspective, we used the concept of “political communication” developed by Brazilian and Portuguese historians. Methodologically, we adapted the concept of “political communication” to the reality of the Mato Grosso captaincy, taking into consideration that the distances between villages and the capital imposed the form of administration by correspondence, as also happened with Portugal and its overseas domains.

El magistrado asumía la presidencia de las Cámaras Municipales cuando estaba presente en una localidad. Cabe resaltar que, los jueces externos en la América portuguesa traían otros encargos anexos a su jurisdicción. Además, en Vila Real do Cuiabá, se encontraron magistrados que desempeñan funciones administrativas que van más allá de la justicia, como mantener el Almacén Real y enviar suministros y municiones a las villas militares en el río Paraguay. Un detalle de las acciones administrativas se encuentra en las cartas enviadas por los jueces externos a los gobernadores, que radicaban en la capital, Vila Bela, y que están archivadas en el Archivo Público de Mato Grosso (APMT). Este modelo de correspondencia es una pieza importante para una mejor comprensión de la rutina administrativa del pueblo, del papel de los jueces externos en este proceso, y también de sus espacios de poder dentro del cuerpo de autoridades de la capitanía. El objetivo de este artículo es, por lo tanto, analizar el contenido de las cartas, con especial atención a las funciones extrajudiciales realizadas por los jueces externos en la Vila do Cuiabá, así como la relación entre estos oficiales y los gobernadores de la capitanía de Mato Grosso entre los años 1767 y 1796. Para ello, metodológicamente llevamos a cabo una adaptación a la realidad de la capitanía de Mato Grosso del concepto de "comunicación política", que recientemente ha sido pensado para una mejor comprensión de la administración de las conquistas en el Imperio portugués.A criação do cargo de juiz de fora representou um dos esforços da Coroa portuguesa para cercear os poderes das elites locais. O magistrado assumia a presidência das Câmaras Municipais quando estava presente em uma localidade. Além disso, os juízes de fora na América portuguesa traziam consigo vários outros encargos anexos a sua jurisdição. Na Vila Real do Cuiabá, os magistrados cumpriam funções de caráter administrativo que iam para além das justiças, como as de manutenção do Armazém Real e envio de mantimentos e munições para os povoados militares do Rio Paraguai. O detalhamento das atividades administrativas, por sua vez, é encontrado nas cartas enviadas pelos juízes de fora aos governadores, estabelecidos na capital, Vila Bela. Tais fontes se encontram guardadas no Arquivo Público de Mato Grosso (APMT). As correspondências constituem-se em peça importante para maior conhecimento sobre o cotidiano administrativo da vila, do papel dos juízes de fora e de seus espaços de poder no interior do corpo de autoridades da capitania. O objetivo deste artigo é, portanto, analisar o conteúdo das cartas, com especial atenção às funções extrajudiciais exercidas pelos juízes de fora na Vila do Cuiabá, bem como a relação entre estes oficiais e os governadores da capitania do Mato Grosso entre os anos de 1767 e 1796. Do ponto de vista teórico, utilizamos o conceito de “comunicação política” desenvolvido por historiadores brasileiros e portugueses.
