Resumo: La garantía del contenido esencial de los Derechos Fundamentales está ausente en la Ley Fundamental mexicana. Por este motivo, para encontrar un fundamento hermenéutico que provea de certeza a los diferentes ordenamientos legales es necesario buscar en la jurisprudencia mexicana. Este trabajo de investigación se ocupa de la tesis de la configuración de los derechos fundamentales a través del principio de proporcionalidad el cual es empleado para concretar el contenido de los derechos humanos.
