This article presents a discussion about the importance of public policies and processes of legitimation of human rights for children and adolescents in the context of the capitalist system, revealing the mechanisms of its implementation after the Brazilian Federal Constitution of 1988. Thus, it presents the challenges of achieving human rights for children and youth in terms of education, health, sports and leisure, as well as in terms of family and community relationships, and in the material and concrete relations that are established in the social environment in which the children, adolescents and their families are inserted. It also seeks to demonstrate that human rights constitute an important foundation of the democratic, which cannot be denied without emptying the meaning of citizenship that underlies this model of State and society.
