Forensic Pedagogy: humanizing and emancipatory perspectives in the work with judicialized children and youth

Resumo: | The present work, linked to two doctoral research in development, presents notes on the practices developed by pedagogues in the Childhood and Youth Courts of the State Courts of Justice, notably in procedural actions that deal with children and adolescents with rights threatened or violated. Through a bibliographic study, we sought to identify the theoretical-methodological elements that support the pedagogical practice in the judiciary, as well as the purposes that guide it. In view of this, it is understood that the legal pedagogue, as a component of the interprofessional team, must guide their intervention from the perspective of critical theories of education (GALO; MELO, 2021), understood as social practice (FREIRE , 1976), and to develop approaches and procedures that meet the legal purpose of the action, which consists of supporting the judicial decision through specialized technical knowledge; and also to the pedagogical purpose whose objective is to contribute to human formation and the exercise of citizenship. |

Ante ello, se entiende que el pedagogo jurídico, como componente del equipo interprofesional, debe orientar su intervención desde la perspectiva de las teorías críticas de la educación (GALO; MELO, 2021), entendida como práctica social (FREIRE, 1976) , y desarrollar criterios y procedimientos que respondan al objeto jurídico de la acción, que consiste en sustentar la decisión judicial mediante conocimientos técnicos especializados; y también a la finalidad pedagógica cuyo objetivo es contribuir a la formación humana y al ejercicio de la ciudadanía.O presente trabalho é vinculado a duas pesquisas de doutorado em desenvolvimento e apresenta apontamentos sobre as práticas desenvolvidas por pedagogos(as) nas Varas da Infância e da Juventude dos Tribunais de Justiça Estaduais, notadamente em ações processuais que tratam sobre crianças e adolescentes com direitos ameaçados ou violados. Por meio de estudo bibliográfico, buscou-se identificar os elementos teórico-metodológicos que dão subsídios à prática pedagógica no judiciário, assim como as finalidades que a norteiam.
