The fictionalization of divorce in Dona Anja

Resumo: | This article examines how the fictional record of the approval of the Constitutional Amendment of Divorce, introduced into the Brazilian legal system in 1977, occurs. In order to verify how this record occurs, the novel Dona Anja (1978), by Josué Guimarães (1921-1986), was chosen. The literary narrative develops in the house (brothel), of the character Dona Anja, where the city authorities gather to listen on the radio to the vote on the divorce amendment. In the context of the novel, an analysis of the society of the time divided between divorces and anti-divorcists is produced. It starts, for this, from the understanding that the work is a representation and as such elaborates a rereading of the object, produced from the interpretation, of the author’s worldview, fictionalized in the narrative. The research has a bibliographic nature, in the dialogue of the Literature with/in History, and with Law, since the subject addressed is a legal issue. Finally, it is observed Josué Guimarães, in the writing of this literary text, and in a critical way, presents a vision of an event of his time (of experience and witness of his time and of the writing of the novel), thus fulfilling one of the literary functions, that oh being a social product that, in this scenario, was that of criticism of the current regime in his corrupted society. |

Para verificar cómo ocurre este registro, se eligió la novela Dona Anja (1978), de Josué Guimarães (1921-1986). La narrativa literaria se desarrolla en la “casa” (burdel) del personaje Dona Anja, donde las autoridades de la ciudad se reúnen para escuchar en la radio la votación sobre la enmienda al divorcio. En el contexto de la novela, se produce un análisis de la sociedad de la época dividida entre divorciados y antidivorciados. Parte, para ello, de la comprensión de que la obra es una representación y como tal elabora una relectura del objeto, producida a partir de la interpretación, de la cosmovisión del autor, ficcionalizada en la narrativa. La investigación tiene un carácter bibliográfico, en el diálogo de la Literatura con/en la Historia, y con el Derecho, ya que el tema abordado es una cuestión jurídica. Finalmente, se observa que Josué Guimarães, en la redacción de este texto literario, y de manera crítica, presenta una visión de un acontecimiento de su tiempo (de experiencia y testimonio de su tiempo y de la escritura de la novela), cumpliendo así una de las funciones literarias, la de ser un producto social que, en este escenario, era el de crítica del régimen actual en su sociedad corrupta.Este artigo examina como ocorre o registro ficcional da aprovação da Emenda Constitucional do Divórcio, introduzida no ordenamento jurídico brasileiro em 1977. Com a finalidade de verificar como se dá esse registro, elegeu-se o romance Dona Anja (1978), de Josué Guimarães (1921-1986). A narrativa literária se desenvolve na “casa” (bordel) da personagem Dona Anja, onde as autoridades da cidade reúnem-se para escutar pelo rádio a votação da emenda divorcista. Na contextualização da novela, produz-se uma análise da sociedade da época dividida entre divorcistas e antidivorcistas. Parte-se, para isso, da compreensão de que a obra é uma representação e como tal elabora uma releitura do objeto, produzida a partir da intepretação, da visão de mundo do autor, ficcionalizada na narrativa. A investigação possui natureza bibliográfica, no dialogo da Literatura com/na História, e com o Direito, uma vez que o assunto abordado é uma questão jurídica. Por fim, constata-se que Josué Guimarães, na escrita deste texto literário, e de maneira crítica, apresenta uma visão de um acontecimento de sua época (de vivência e testemunha de seu tempo e da escrita da novela), cumprindo, desse modo, com uma das funções literárias, a de ser produto social que, neste cenário, foi o de crítica ao regime vigente em sua corrompida sociedade.
