However, during the covid-19 pandemics, the then-President Jair Bolsonaro refrained from the task of coordinating and even attempted to undermine the state policies designed by the opposing governors. Given the absence of federal coordination, it is relevant to investigate the behavior of the judiciary in the resolution of federative conflicts. In this paper, we mapped how 15 state courtsresponded to federative conflicts regarding the public health policies designed to face covid-19 pandemics. The data shows that, no matter how aligned the states were to Bolsonaro’s government, the state courts behaved with uniformity, usually favoring restrictive policies.

Durante a pandemia de covid-19, contudo, o então Presidente da República, Jair Bolsonaro, abdicou da tarefa de coordenação e procurou obstruir políticas adotadas por governadores. Esta ausência de coordenação aumentou ainda mais a relevância da resolução de conflitos federativos, usualmente canalizados no judiciário. Neste artigo, analisamos qual foi a resposta dos tribunais de justiça de 15 estados em conflitos relativos às políticas de combate à pandemia.
