O IPTU na crise arrecadatória decorrente da pandemia (covid-19) / The iptu in the tax collection crisis resulting from the pandemic (covid-19)

Resumo: | ResumoO objetivo deste trabalho é analisar as possíveis manifestações extrafiscais do IPTU que podem servir de instrumento fiscal para enfrentamento da crise econômica de arrecadação decorrentes da pandemia de Coronavírus (COVID-19). A partir de investigação que priorizou o método hipotético-dedutivo, analisou-se quais foram as medidas imediatas diante da pandemia do Coronavírus adotadas pela municipalidade e o posicionamento do judiciário diante das demandas de contribuintes a partir de levantamento de dados por consulta normativa e jurisprudencial, respectivamente. Também se realizou pesquisa bibliográfica sobre as possibilidades de progressividade. Com relação à estrutura do trabalho, iniciou-se indicando a política tributária e a extrafiscalidade como medidas de combate à pandemia, a inadequação do IPTU como um problema antecedente à pandemia e as possibilidades constitucionais fiscais e extrafiscais do IPTU (1). Analisou-se cada uma destas possibilidades a partir do critério da progressividade (2). Identificou-se quais foram as respostas imediatas normativas das localidades – na maioria dos casos a simples prorrogação de prazos para o pagamento – e judiciais – suspensão de liminar de concessão de prorrogação de prazos para o pagamento do IPTU – diante da crise econômica. Identificou-se, ainda, a necessidade da aplicação da progressividade como medida mediata de enfrentamento às crises geradas pela pandemia (3). Por fim, concluiu-se sugerindo que a progressividade do IPTU seja utilizada como instrumento extrafiscal de enfrentamento da crise econômica de arrecadação pelos municípios (4).Palavras-chave: COVID-19; IPTU; Extrafiscalidade; Progressividade.
