Resumo O presente trabalho, a partir da análise de um conjunto selecionado de leis que, produzidas desde o início do século XX, buscam lidar com as favelas cariocas, tem como objetivo refletir sobre a maneira pela qual o estado e a sua ordem jurídica produziram esses territórios enquanto margens. A revisão bibliográfica emerge como o método adequado para este fim na medida em que também analisamos como as narrativas ligadas à teoria da marginalidade foram paulatinamente identificando nas favelas a imagem que por excelência preenchia sua definição. Por outro lado, utilizamos também o método documental para lidar com a leitura das leis no período observado. O artigo propõe contribuir ao debate, dentro do campo do direito e dos estudos urbanos, sobre o lugar do estado e das normas jurídicas na produção e gestão de suas próprias margens.Palavras-chave: Margem; favelas; informalidade; marginalidade, estado  Abstract The present paper, based on the analysis of a selected set of laws that, produced since the beginning of the twentieth century, seek to deal with Rio's favelas, aims to reflect on the way in which the state and its legal order have produced these territories as margins. The bibliographical review emerges as the adequate method to this end insofar as we also analyze how the narratives linked to the theory of marginality gradually identified in the favelas the image that per excellence fulfilled their definition. On the other hand, we also used the documental method to deal with the reading of the laws in the observed period. The article proposes to contribute to the debate, within the field of law and urban studies, about the place of the State and the legal norms in the production and management of its own margins.Keywords: Margin; slums; informality; marginality, State
