Aceito em 12 de janeiro de 2016.DOI: 10.12957/rqi.2016.19289ResumoO artigo tem por objeto a teoria dialético-materialista de Michel Miaille e objetiva analisar a existência de um postulado essencialista em tal teoria. Enquanto teoria do direito, a dialética-marxista de Miaille, em resumo, busca explicar o fenômeno jurídico a partir da sociedade, rompendo tanto com o positivismo jurídico quanto com o jusnaturalismo. O direito é definido em sua estrutura social, com a possível exclusão do essencialismo de sua análise. Ainda assim, parece que há um postulado essencialista no pensamento de Miaille, tanto como constitutivo do método holista, quanto pela vinculação do direito à justiça social. Diante disso, metodologicamente, a pesquisa analisará se há, de fato, um postulado essencialista no pensamento de Miaille e, sequencialmente, o problema do essencialismo à luz da filosofia de Nietzsche.Palavras-chave: Direito; Teoria do Direito; Dialética-Materialista; Essencialismo; Crítica.AbstractThe article focuses on the dialectical-materialist theory of Michel Miaille and aims to analyze the existence of an essentialist assumption in such a theory. While theory of law, the dialectic-Marxist Miaille, in short, seeks to explain the legal phenomenon of the society, breaking both with legal positivism as with the natural law. The right is defined in its social structure, with the possible exclusion of essentialism of his analysis. Still, it seems that there is an essentialist assumption in thinking Miaille, both as a constituent of the holistic method, and by linking the right to social justice. Therefore, methodologically, the research will examine whether there is indeed an essentialist assumption in thinking Miaille and sequentially, the problem of essentialism in the light of Nietzsche's philosophy. From the performed analysis of critical philosophy of Nietzsche, the article concludes that the dialectical-materialist theory of Michel Miaille submit a rhetorical importance, but fails to seek to extract a possible truth of the social structure that justifies the concept of law presented by the author.Keywords: Law; Theory of Law; Materialist Dialectic; Essencialism; Criticism.
