Sem qualquer pretensão de esgotar o tema, dá-se ênfase ao referido instituto sob a égide da ordem jurídica portuguesa e brasileira sem prejuízo de outras que se demonstram correlatas. O trabalho visa estabelecer diferenças entre a proposta ao público e o convite a contratar e, de certa forma, superar a descrença na efetividade das ofertas ao público. PALAVRAS-CHAVE: Oferta ao público, Contratos, Convite a contratar, Modalidades de Oferta, Consumidor.   ABSTRACT:The present article is intended to analyze one of the most usefull contemporary contract modalities, which is the offer to the public. Without any ambition of exhausting the topic, it is given emphasis on the referred institute under the auspice of the Portuguese and Brazilian Legal order, with no prejudice for the correlated ones. This study aims to establish differences between the proposal to the public and the invitation to purchase and, in some way, to overcome disagreements on the offer to public effectiveness.   KEY WORDS: Offer to the public, Contracts, Invitation to purchase, Offer modalities, Consumer.
