O artigo busca demonstrar que a prática da tortura, por ter se tornado um crime internacional, e a proibição da tortura, por ter se tornado uma norma de jus cogens, implicam no afastamento da regra da imunidade de jurisdição criminal em relação a um ato cometido na função de ex-Chefe de Estado. Abstract This article examines the trial of Augusto Pinochet, ex-Head of State, in the House of Lords of the United Kingdom, from the perspective of international human rights and its nature as norms of jus cogens. The article seeks to demonstrate that the practice of torture by becoming an international crime, and the prohibition of torture, to have become a norm of jus cogens, involving the removal of the rule of immunity from criminal jurisdiction in respect of an act committed in function ex-Head of State.
