A adoção da Análise Comportamental do Direito (ACD) em complemento à Análise Econômico-Comportamental do Direito (AED Comportamental) trará uma vantagem para o pensamento do sistema jurídico, dotando-o de uma robusta teoria geral sobre o comportamento humano (behaviorismo). A AED Comportamental tem o mérito de identificar que nem sempre o modelo clássico da Análise Econômica do Direito (AED), que se baseia na teoria das escolhas racionais, se mostra condizente com dados empiricamente coletados. Todavia, a ausência de uma teoria geral do comportamento e a adoção de premissas teóricas (oriundas da psicologia cognitivista) que retiram o foco das causas em que o Direito realmente poderá atuar (ambiente e contingências) podem enfraquecer o potencial de contribuição para o Direito que os experimentos realizados na disciplina possuem, tornando-a alvo de críticas. Assim, a ACD, por ser compatível com os resultados dos inúmeros experimentos realizados no âmbito da AED Comportamental, pode agregar valor a esta, aperfeiçoando as contribuições para que o Direito regule melhor a vida em sociedade, bem como para o aperfeiçoamento das políticas públicas.Palavras-chave: Análise Comportamental do Direito; Behaviorismo; Análise Econômico-Comportamental do Direito; Análise Econômica do Direito; psicologia cognitivista.AbstractThe adoption of the Behavioral Analysis of Law (BAL) coupled with the Behavioral Law and Economics Analysis (BLE) brings an advantage to the thinking of the legal system, endowing it with a robust general theory about human behavior (behaviorism). The BLE has the merit of identifying that the classic model of Law and Economics Analysis, which is based on the rational choice theory, is not always consistent with empirically collected data. However, the absence of a general theory of behavior and the adoption of theoretical premises (derived from cognitive psychology) that withdraw the focus of the causes in which Law can really act (environment and contingencies) might weaken the potential contribution to Law that the experiments performed in the discipline possess, making it subject to criticism. Thus, BAL, as it is compatible with the results of the numerous experiments accomplished within the framework of the BLE, can add value to the former, enhancing the contributions in a way that enables the Law to better regulates life in society, as well as for the improvement of public policies.Keywords: Behavioral Analysis of Law; Behaviorism; Behavioral Law and Economic Analysis; Economic Analysis of Law; cognitive psychology.
