Sua teoria vem sendo acolhida com grande entusiasmo pelos teóricos brasileiros, tendo em vista seu viés igualitarista. Todavia, a teoria também foi alvo de críticas, dentre as quais as da vertente econômica. O artigo estabelece os conceitos fundamentais da teoria da justiça de John Rawls, notadamente a posição original, o véu da ignorância e a regra de decisão maximin, para, em seguida, apresentar as críticas formuladas por dois economistas e um teórico da análise econômica do direito. Richard A. Musgrave enfoca o elo estabelecido por John Rawls entre a teoria da justiça e a teoria da decisão racional, bem como as inter-relações entre aversão (ou não) a risco e véu da ignorância. John C. Harsanyi critica a racionalidade das partes na posição original, sustentando que deveria ser outra a regra de decisão (racionalidade) adotada, bem como outro deveria ser o princípio de justiça escolhido. Richard A. Posner tenta criar uma nova concepção de justiça como eficiência, segundo a qual justo será o ato ou instituição social que maximizar a riqueza da sociedade. Abstract:John Rawls’ A Theory of Justice brought the debates about justice back to academia. His theory has been accepted with great enthusiasm by Brazilian theorists, given their egalitarian bias. However, the theory has also been the target of criticism, including from the economic sphere. The article establishes the fundamental concepts of John Rawls’ theory of justice, notably the original position, the veil of ignorance and the maximin rule of decision making, and then presents the criticism by two economists and a theorist from the field of economical analysis of Law. Richard A. Musgrave focuses on the link established by John Rawls between the theory of justice and the theory of rational decision making, as well as on the interactions between aversion to risk (or lack thereof) and the veil of ignorance. John C. Harsanyi criticizes the rationality of the parties in the original position, arguing that another rule of decision making (rationality) should be adopted, and that another principle of justice should be the one chosen. Richard A. Posner seeks to create a new conception of justice as efficiency, according to which just would be the act or social institution that maximizes wealth in society.
